      Although adopted by the UN General Assembly in 1990, the International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families remains the least ratified convention among all the human rights treaties and the great majority of those that have ratified are migrant-sending countries. Ruhs (political economy, U. of Oxford, England) suggests that this is the result of an unbalanced perspective on migrant rights that stresses only their intrinsic value and fails to account for the instrumental role of migration for receiving countries, migrants, and their countries of origin, which requires nation-states to balance interests and rights in crafting their immigration policies. Thus, in order to more realistically bridge the gap between the normative understanding of migrant rights and the instrumental role of migrant rights restrictions, he contends, we must begin to account of the economic, social, political, and other consequences of migrant rights for the national interests of all interested parties. He seeks to find a balance between the normative and the instrumental in his analysis of the realities of international migration regimes, arguing that insistence on the broad rights of current international labor standards may do good in one area (promoting the rights of existing migrants) while creating harm in another (restricting the rights of other workers to migrate and legally work in higher-income countries) and arguing for the identification of a few core rights, rather than the broad rights defined by the existing convention.
